It had paid Pfizer $13 million to settle nearly 20 years ago over patents in the erectile dysfunction medicine Cialis, but Pfizer paid $13 million to resolve the case.
Pfizer had filed for the patent on Viagra in 2015, and had been able to extend that patent to include a generic version of the drug, which is sold under the brand name Levitra. Pfizer claimed that the generic version of the drug was effective in treating erectile dysfunction.
But Pfizer lost that case and it now faces a lawsuit from two of its major drugmakers, Valeant Pharmaceuticals and Eli Lilly & Co., who argue that Pfizer's patent on Cialis had a negative effect on its drug.
"The patent on Viagra is valid and enforceable," said David J. Rosen of the Center for Drug Evaluation and Research. "Pfizer should have known about the negative effect before it launched the drug."
Pfizer's patent on Cialis expired in June 2020, but the company is still negotiating with Pfizer about its future.
Pfizer has been struggling with the litigation over Cialis, but the drugmaker has not paid any legal costs.
The lawsuit, brought by the consumer group Consumers Union, claims that Pfizer failed to take the steps necessary to secure an exclusive agreement with its patent-holder, which is the makers of Cialis and Levitra.
The suit alleges that the company was aware of Pfizer's patent and had promised to pay the parties an amount that is not disclosed in the settlement agreements. The suit also seeks a court order, requiring Pfizer to pay the makers of Cialis, and also seeks a $50 million settlement and $130 million in damages to the consumer group.
Pfizer's share of the settlement was $50.4 million.
Pfizer had previously filed a class-action lawsuit against two of its major drugmakers, which alleged that Pfizer had withheld information about its drug's patent and failed to disclose that it had the drug's active ingredient, Viagra.
A Pfizer spokesman said Pfizer had reached a deal with the drugmaker to pay the companies $50 million to resolve the lawsuit.
"We understand the concerns about the litigation, but we remain committed to our commitment to resolve these matters," said David P. Schulich, Pfizer's chief executive officer.
Pfizer's suit names the company as an defendant in the class-action lawsuit.
